Custom-Made Products

Every product sold by Uniquely Magnetic is custom made specifically for you. Production begins shortly after your order has been placed and payment has been successfully processed.

Because each item is personalized, customers are responsible for reviewing all submitted artwork, photographs, names, dates, spelling, colors, and personalization details before completing their purchase.

Once production has begun, orders cannot be modified or canceled.

Production & Processing Time

All orders are processed and manufactured within three (3) business days of receiving payment.

Processing time does not include shipping time.

While we strive to meet all estimated production dates, occasional delays may occur during holidays, peak seasons, equipment maintenance, or supply shortages. Should a significant delay occur, we will notify you as soon as possible.

Customer Submitted Artwork

By uploading or submitting any photograph, logo, artwork, image, design, text, or other content ("Submitted Content"), you represent and warrant that:

• You own the Submitted Content; or
• You have obtained all necessary licenses, permissions, or written authorization to reproduce and use the Submitted Content.

You further certify that your Submitted Content does not infringe upon any copyright, trademark, patent, publicity rights, privacy rights, or other intellectual property rights belonging to another person or organization.

You accept full legal responsibility for all Submitted Content.

Copyright & Trademark Policy

Uniquely Magnetic respects the intellectual property rights of others.

We reserve the right to refuse, cancel, or refund any order that appears to contain unauthorized or infringing content, including but not limited to:

• Copyrighted artwork
• Trademarked logos
• Professional sports team logos
• College or university logos
• Military emblems or insignia submitted without proper authorization
• Corporate branding
• Licensed characters
• Celebrity images
• Artwork downloaded from the internet without reproduction rights
• AI-generated artwork that violates another creator's rights
• Offensive, hateful, defamatory, obscene, or illegal material

Acceptance of an order does not constitute verification that you possess the legal right to reproduce the submitted content.

Right to Request Proof of Authorization

Uniquely Magnetic reserves the right to request documentation demonstrating your legal right to reproduce any submitted image or design before manufacturing your order.

Failure to provide satisfactory proof may result in cancellation of the order and a refund at our discretion.

Customer Indemnification

By placing an order, you agree to defend, indemnify, and hold harmless Uniquely Magnetic, its owners, employees, contractors, affiliates, successors, and assigns from any claims, damages, losses, liabilities, judgments, costs, or attorney's fees arising from:

• Your Submitted Content
• Alleged copyright infringement
• Trademark infringement
• Violations of publicity or privacy rights
• Any other legal claim relating to the materials you provided

Our Right to Refuse Orders

Uniquely Magnetic reserves the right, at our sole discretion, to:

• Refuse any order
• Cancel any order before production
• Remove offensive or inappropriate designs
• Decline requests that violate applicable laws
• Decline orders that may expose our business to legal liability

If an order is canceled before production begins, a refund may be issued.

Returns & Refunds

Because every item is custom made specifically for each customer:

All sales are final.

We do not accept returns or exchanges for:

• Personalized products
• Custom artwork
• Customer design errors
• Customer spelling mistakes
• Color preferences
• Buyer remorse

Replacement or refund requests will only be considered if:

• The product arrives damaged during shipping.
• The wrong item was received.
• The product contains a manufacturing defect.
• The personalization differs from the information submitted with the order.

Claims for damaged or incorrect products must be submitted within 7 days of delivery and include photographs of the product and packaging.

Color & Image Disclaimer

Printed colors may vary slightly due to:

• Computer monitors
• Mobile device displays
• Screen calibration
• Printing processes
• Material variations

Minor color differences are considered normal and are not considered defects.

Customers are responsible for ensuring uploaded images are of sufficient quality for printing. Images with low resolution may produce lower-quality results.

Ownership of Artwork

Customers retain ownership of any original artwork they submit.

Uniquely Magnetic retains ownership of:

• Product mockups
• Marketing materials
• Templates
• Original artwork created by us
• Website content
• Product photography
• Graphic designs created by our staff

Unless otherwise agreed to in writing, no rights to our original designs are transferred to customers.

Marketing Use

Unless you specifically request otherwise in writing before production begins, Uniquely Magnetic reserves the right to photograph completed products and use those photographs for:

• Website galleries
• Social media
• Advertising
• Promotional materials
• Product portfolios
• Printed marketing materials

We will never sell or license your original submitted artwork.

Limitation of Liability

To the maximum extent permitted by law, the liability of Uniquely Magnetic for any claim relating to an order shall not exceed the purchase price actually paid for the product.

We shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the purchase or use of our products.

Governing Law

These Terms and Conditions shall be governed by and interpreted under the laws of the State of Colorado, without regard to its conflict of law principles.

Changes to This Policy

Uniquely Magnetic reserves the right to modify or update this policy at any time without prior notice. Any changes become effective immediately upon posting to our website.
